1. Acceptance of Terms

By accessing or using AskClash ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

AskClash is a decision intelligence platform that provides:

AI-powered research and analysis across sports, crypto, stocks, and general topics
Sports predictions with confidence scoring, edge analysis, and Monte Carlo simulations
Crypto and stock technical analysis with interactive charts
Portfolio tracking with optional read-only wallet connection
Prediction marketplace integration with ClashPicks
Video summary tools for YouTube content

The Service uses multiple AI models and real-time data sources to generate responses. The Service is currently in beta.

3. Eligibility

You must be at least 18 years old to use the Service. By using AskClash, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

4. Accounts and Authentication

You may create an account using Google Sign-In, Apple Sign-In, or email magic link.
You are responsible for maintaining the security of your account and any connected wallets.
You may not share your account credentials or beta key with others.
We reserve the right to suspend or terminate accounts that violate these terms.
You may delete your account at any time by contacting support.

5. Wallet Connect

If you choose to connect a Solana or Ethereum wallet:

The connection is strictly read-only. AskClash reads your public on-chain token balances to populate your portfolio tracker.
AskClash will never request transaction signing authority, access to your private keys, or the ability to move tokens.
You can disconnect your wallet at any time through Settings.
$CLASH token holders may receive subscription discounts based on their wallet balance. This is the only programmatic use of wallet data beyond portfolio display.
AskClash is not responsible for the security of your wallet or any transactions you make outside our platform.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, scrape, or programmatically extract data from the Service
Circumvent rate limits, access controls, or authentication mechanisms
Use the Service to generate spam, misleading content, or harmful material
Resell, redistribute, or commercially exploit the Service or its outputs without written permission
Attempt to manipulate prediction outcomes or game results
Use the Service to facilitate insider trading, match-fixing, or any form of fraud

7. Intellectual Property

The Service, including its design, code, branding, algorithms, and AI-generated outputs, is owned by AskClash and its operators. You may use AI-generated responses for personal and informational purposes. You may not claim AI-generated outputs as original human-authored work for commercial publication without attribution to AskClash.

Not Financial Advice

Crypto, stock, commodity, and market analysis provided by AskClash is for informational and educational purposes only. It does not constitute financial, investment, or trading advice. You should consult a qualified financial advisor before making investment decisions. Past performance of predictions does not guarantee future results.

Not Betting Advice

Sports predictions, confidence scores, spread analyses, and edge assessments are for informational and entertainment purposes only. AskClash does not operate a sportsbook, accept wagers, or facilitate gambling. Predictions should not be relied upon as the sole basis for betting decisions. Sports betting involves significant risk of financial loss. You are solely responsible for any bets you place on third-party platforms.

AI Limitations

AI-generated content may contain errors, outdated information, or biases. AskClash uses multiple data sources and AI models but cannot guarantee accuracy. Always verify important information independently before acting on it.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, AskClash and its operators, employees, and affiliates shall not be liable for:

Any direct, indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or goodwill
Financial losses resulting from acting on predictions, analysis, or AI-generated content
Losses resulting from unauthorized access to your account or wallet
Service interruptions, downtime, or data loss

Your total liability to AskClash, and AskClash's total liability to you, shall not exceed the amount you have paid for the Service in the preceding 12 months, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless AskClash and its operators from any claims, losses, or damages arising from your use of the Service, your violation of these terms, or your violation of any third party's rights.

11. Beta Program

The Service is currently in beta. Features may change, break, or be removed without notice. Beta access may be revoked at any time. By using the beta, you acknowledge that the Service is under active development and may not function as expected.

12. Third-Party Services

AskClash integrates with third-party services including ClashPicks, Google, Apple, OpenAI, Anthropic, ESPN, CoinGecko, and others. Your use of these integrations is subject to the respective third party's terms and policies. AskClash is not responsible for the availability, accuracy, or actions of third-party services.

13. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated through the Service or via email. Continued use after changes constitutes acceptance of the updated terms.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 12 survive termination.

15. Governing Law and Disputes

These terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
